Welcome to Lokely, operated by Lokely, Inc. (the “Company” or “Lokely”). By accessing the Lokely mobile application or its website found at lokelyapp.com, whether through a mobile device, mobile application or computer (the “Service”), you agree to be bound by this privacy policy (the “Policy”), whether or not you create a Lokely account. Lokely has created this Policy in order explain our privacy practices. The following discloses our information-gathering and -dissemination practices for our Service. By using the Service, you do hereby warrant and represent that you have read, understand and agree to all terms and conditions stated herein, including our Terms of Use, available at lokelyapp.com/terms, which is incorporated herein by reference, which govern the use of the Service offered by Lokely, and that you are giving Lokely permission to use and store such information consistent with this Policy and our Terms of Service. Information Received by Lokely

Personal Information. We may collect information that can identify you such as your name, date of birth and email address (“personal information”) and other information that does not identify you such as your interests and location. We may collect this information through the Site or the Service. By using the Service, you are authorizing us to gather, parse and retain data related to the providing and administering of the Service. You may browse the Site without disclosing any personal information. However, in order for you to utilize the mobile device application and to take advantage of particular opportunities provided through the Service, you will be required to furnish limited personal information, such as your name, birthdate, email address, interests and personal description. When you visit and interact with the Site, Lokely and/or third parties with whom Lokely has contracted to provide services to Lokely may collect your Internet Protocol Address (“IP Address”), which is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited. We use IP Addresses to monitor the regions from which Users navigate the Site and for fraud prevention purposes. In order to access certain features and functions of the Service, including, without limitation, tipping and collecting tips received, we may also require you to provide us with your financial information for the use of our third-party partners, including billing name, address and credit card number (“Financial Information”). Your Financial Information will not be collected, stored or utilized by Lokely. All Financial Information provided to Lokely is solely and exclusively collected, stored and utilized by Braintree, a division of PayPal, Inc. (hereinafter, “Braintree”). Only authorized Lokely staff have access to your personal information in its entirety. Other staff may have access to portions of this information if it pertains to their job duties and the offering and administration of Lokely’s Services.

Lokely's Use of Personal Information

Lokely uses Personal Information for the following general purposes:
· to provide our products and the Service,
· for tipping, identification and authentication, and fraud prevention,
· to match you with other Lokely Users based on your location, age, interests and personal information,
· to analyze Site and Service usage and improve our products and the Site and Service,
· to contact you and deliver administrative notices and communications relevant to your use our products and services,
· for internal market research, troubleshooting problems, and detecting and protecting against error, fraud or other criminal activity,
· for distribution to third-party contractors that provide services to Lokely and partners of Lokely who are bound by privacy restrictions at least as restrictive as those set forth in this Policy,
· to enforce our Terms of Service, and
· as otherwise set forth in the Policy. Although we ensure that our third party agents (“Agents”) receiving your information are bound by privacy restrictions at least as restrictive as those set forth in this Policy, Lokely is not responsible for any issues that may arise regarding the Privacy Policies of any of its affiliates, vendors, suppliers, advertisers or any other third-parties which receive personal information from Lokely whether with or without the consent of Lokely. By using this Service and Site, you do hereby agree to hold Lokely harmless from any claims and/or damages that may arise from the actions of any of its affiliates, vendors, suppliers, advertisers and/or any other third-parties which receive personal information from Lokely whether with or without the consent of Lokely. Two things drive Lokely’s decisions regarding the use of information collected from Users: 1) improving User experience by offering personalized services, content, information and advertising, and 2) market research. Ads are a standard part of user experience on the Internet, and Lokely believes that targeted advertising enhances this experience. Lokely may use Cookies, your location and other technologies and personal information to place ads, sponsored content or other commercial solicitation where it believes interested parties, including Users, will see them. In addition to banner ads, Lokely may advertise products, companies and events that we think might interest you through the email address you provide, through instant messaging in the Service, through push notifications to your mobile device or in any other manner which does not violate the terms contained herein. Lokely may analyze personal information and Web Navigational Data based on your interests, location and age, and may use the analysis from this information in a way that doesn’t reveal a User’s personal information (“Market Research”) in order to:
· Market the Service,
· Improve the likelihood of a sale to a group of Users, or
· Increase the likelihood that a group's experience with the Service is relevant to its interests as a whole. Lokely uses data at the individual level to sell, offer and inform Users of products and services to Users who express an interest in these products and services, through a poll for example, or to Users who can be presumed to have an interest based on results from our Market Research. Lokely may use your cell phone number to call or text you in order to provide the Service. Choice/Opt-Out

You may opt-out of receiving communications from other Users and choose not to receive future communications unrelated to the Service. During registration, you choose whether to receive instant messages from other Lokely Users whether to receive push notifications to your cellular device and whether you want to participate in a variety of Lokely features, including without limitation, tipping and receiving tips. This information remains on your Settings where you can, at any point, easily edit it to indicate that you have changed your mind. After logging on, click on your profile on the bottom right of any page, then select settings in the top left corner of your profile page and make your settings selections. ” . Lokely’s Information Retention Policy

To preserve the integrity of our databases and to refine our Service, we may retain personal information submitted by Users for an indefinite length of time. If required by law, we will delete personal information by erasing it from our database. We will also respond to User requests to delete or correct account or personal information, which you can do by contacting Lokely at info@Lokelyapp.com. Lokely’s Security of Collected Information Your Lokely account is password-protected so that only you and authorized Lokely staff have access to your account information. In order to maintain this protection, do not give your password to anyone. If someone who represents to you they are Lokely staff and asks for any personal account information, including password, check their URL. If it doesn't say they are info@Lokelyapp.com, they aren’t. Also, if you share a computer or cellular device, you should sign out of your Lokely account and close the browser window before someone else logs on. This will help protect your information entered on public terminals from disclosure to third parties. Lokely makes every effort to ensure that your information is secure on its system by backing up data in separate back up drives and uses public key access encryption and firewalls on both our main and backup servers. Only certain authorized Lokely staff can access personal information, and then only if it is relevant to their job duties. Lokely has staff dedicated to maintaining this Policy and other privacy initiatives, periodically reviewing security and making sure that every Lokely employee is aware of our security practices. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, Lokely cannot guarantee the security of any information you transmit to us, and you do so at your own risk. While Lokely will use commercially reasonable efforts to ensure the security of all personal information, we expressly disclaim any liability for any unauthorized access to or use of our secure servers and/or any and all personal information and/or Financial Information stored therein, and you agree to hold Lokely harmless to the fullest extent of the law for any damages, losses, causes of action, claims, suits, judgments and sums of money that may result therefrom. With whom does Lokely Share Information?

When you submit information to Lokely, it is collected, processed and maintained solely by us or by third party agents who are bound by privacy restrictions at least as restrictive as those set forth in this Policy. We may allow our business partners to collect information about Users that is not extremely sensitive Information. Some Lokely content may be “sponsored by” or “presented by” third-parties. Lokely reserves the right to share market research datacollected on this website, Service or via email with these partners. Partners or other Users may sponsor promotions, contests and sweepstakes that require you to reveal details such as your name, address or phone number. Always check their privacy policy before revealing information about yourself. If you don't want these sponsors to have your personal information, you can choose to not participate. Lokely reserves the right to disclose personal information from both private and public areas of this website at our discretion, if required by law or if we are given reason to believe, in our sole discretion, that someone is causing injury to or interference with the rights of Users, the general public, or Lokely, or to comply with a judicial proceeding, court order, subpoena or other legal process. How can Users Edit Their Information?

Lokely believes strongly in giving you the ability to access and edit your personal information. To update your personal info, click on the My Profile link at the bottom right of any page. There you can view, update and correct your account information. You may edit your account information at any time. Our databases automatically update any personal information you edit in your Settings, or that you request we edit.

Notification of Changes

Lokely’s security and privacy policy are periodically reviewed and enhanced as necessary. This Policy might change as Lokely updates and expands the Service. Lokely will endeavor to notify you of these changes by email, but will not be liable for any failure to do so. Lokely also encourages you to review this Policy periodically. Users from Outside the United States

Lokely and its Service are based in the U.S., and the Company’s offices are headquartered in the U.S. Please be aware that information you provide to Lokely that it obtains as a result of your use of the Service may be processed and transferred to the U.S. and be subject to U.S. law. The privacy and data protection laws in the U.S. may not be equivalent to such laws in your country of residence. No Rights of Third Parties
